For the State The alleged contemnor is present in Court and submits affidavit of further compliance of the order dated 24th August, 2022.

It appears from the affidavit that in terms of the said order, demarcation of the plot in question has been completed and upon assessment of encroachment, notice under Section 10(1) of the West Bengal Highways Act, 1964 has been issued upon the alleged encroachers.

In view of the same, this Court is inclined to hold that order under contempt has been substantially complied with.

Before parting with the record, it is noted that the conduct of the alleged contemnor cannot be appreciated and is taken serious note of. It is hoped and expected that orders of the Court shall not be flouted in future and shall be complied with strictly by the alleged contemnor.

The undertaking given by the alleged contemnor in the affidavit is taken on record.

The contempt application being CPAN 61 of 2022 is disposed of accordingly.
