1. The affidavit-of-service filed by the learned counsel for the petitioner and the report submitted by the learned counsel for the State be kept with the record.
2. The petitioner has filed the present writ application on the ground that the petitioner is performing the Saraswati Puja by constructing a pandal on three point junction of Narasingha Prasad Dutta Road (West to East), Banowari Lal Dhole Land and Narasingha Prasad Dutta Road (North to South) but the private respondents are obstructing the access/egress and ingress of the motor cars at the car parking area at the premises no. 1/9, Narasingha Prasad Dutta Road. He submits that before starting construction of the puja pandal, the private respondents have given an undertaking that they will allow the petitioner to construct the pandal and to perform the puja and they will not obstruct the access/egress and ingress of the motor cars at the car parking area at the premises no. 1/9, Narasingha Prasad Dutta Road.

As per the undertaking given by the private respondents the petitioner is constructed the pandal but now they have obstructing the ingress and egress of the motor cars at the car parking space at the premises no. 1/9, Narasingha Prasad Dutta Road. The petitioner is also made complaint to the police authority.
4. The learned counsel appearing for the State submits the report which reads as follows:
"On 1901.2023 one Srijan Laha s/o Raju Laha (the respondent no. 6) came at Baranagar PS and submitted written declaration that as per commitment made on 18.01.2026, they will construct the structure of pandal leaving the space enough to pass the private cars as well as an emergency vehicle and they will also provide all assistance to the petitioner in case of emergency duly signed by the secretary namely, Partha Sadhukahn, Club President namely Raju Laha and other members. On satisfaction of the letter submitted by the respondent, the petitioner also deposited another self declaration that they shall have no objection to the construction pandal if the Club authority adheres to the aforesaid undertakings. The officer of Baranagar PS provided notice to the petitioner and another notice was issued to the respondent no. (06) to maintain peace and tranquility of the said area duly received by them. This refers to Baranagar PS GDE NO-1508 dated 19.01.2026."
5. Considered the submission made by the learned counsel for the petitioner perused the materials on record and the report submitted by the Officer-in-Charge, Baranagar PS.
6. Learned counsel for the petitioner submits that after filing of the writ application when this Court fixed the matter
today, the private respondents have removed the obstruction.
7. Considering the above, this Court disposed of the present writ application with the direction to the respondents/authorities or any of the persons from obstructing the petitioner for performing the puja at this aforesaid place and for obstructing the ingress and egress of the motor cars at the car parking space at the premises no. 1/9, Narasingha Prasad Dutta Road on January 23, 2026 from 5.30 a.m. to 5.30 p.m.
8. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
