Learned advocate appearing for the petitioner submits that the petitioner was shown arrested in connection with the present case after being in custody for about 9 days in connection with another case under Section 392 of the Indian Penal Code. Learned advocate for the State opposes the prayer for bail and submits that out of 13 witnesses proposed to be examined, 6 witnesses have already been examined.
Be that as it may, having considered the period of incarceration of the present petitioner, I am of the view that further custodial detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sk. Kismat @ Gabbar shall be released on bail upon furnishing
bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Actcum-learned Additional District Judge, 3rd Court, Purulia. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Purulia without the prior permission of the learned special court.
Accordingly, CRM (NDPS) 114 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
