For the State The writ petition has been filed for a direction upon the police authorities to consider the representation dated November 13, 2020.
The representation indicates that the police authorities were requested to take appropriate steps by inserting the appropriate sections in Pandua Police Station Case No. 278 of 2020 dated September 28, 2020. The OPD tickets issued by the Pandua Hospital and photographs were also forwarded.
The police authorities investigated into the matter and found that the disputes between the petitioner and the respondent Nos. 5 to 9 led to physical assault and injuries. Investigation was concluded and a chargesheet being Pandua Police Station charge-sheet No. 296/2020 dated October 31, 2020 under Sections
447/323/325/506/34 of the Indian Penal Code, 1860 had been submitted before the learned jurisdictional Magistrate.
During investigation, formalities were maintained, the place of occurrence was visited, a rough sketch map was prepared, the complainant and the available witnesses were examined. The statements were recorded under Section 161 of the Code of Criminal Procedure. The evidence of the assault and the apparels containing bloodstains had been seized. The injury reports were considered. The miscreants were arrested on September 28, 2020. They were released on bail on September 29, 2020 by the learned Chief Judicial Magistrate. Upon consulting that injury report and the statements of witnesses as also seizures, the police authorities filed charge-sheet.
If the petitioner is aggrieved by non-insertion of any particular section in the charge-sheet, the petitioner is at liberty to follow the procedure as per the Criminal Procedure Code. No order can be passed in this application.
The writ petition is thus disposed of.
There shall be no order as to costs.
