She submits, the application was filed in time and causes shown for missing the appeal when called. Mr. Bhattacharya, learned advocate appears on behalf of respondent and leaves it to Court.

We recall order dated 27th July, 2018 on accepting the causes shown and considering that the application was made in time. The appeal is restored to its file and number.

We find the appeal remains defective.
