Learned counsel appearing on behalf of the petitioner submits that the petitioner would not like to press this application with liberty to file afresh as the same suffers from some incurable defects.

Accordingly, the writ petition is dismissed as withdrawn.

However, this order shall not come in the way of the petitioner in filing a proper application afresh on the selfsame grounds.
