The learned Advocate appearing for the petitioner submits that bail ought to be granted on the ground that the victim girl, during her deposition, turned hostile, and that there is no specific allegation of penetrative assault against the petitioner. It is further submitted that the deposition of the victim girl does not contain any allegation against the petitioner.
A perusal of the deposition of the victim girl, however, makes it clear that there are specific allegations against the petitioner.
Additionally, having regard to the deposition of the doctor, the injury report, and other materials on record, this Court is not inclined to grant bail to the petitioner. The trial is presently ongoing. The prosecution submits that eighteen additional witnesses remain to be examined.
In view of the foregoing, the learned trial judge is directed to make an endeavour to expedite the trial as expeditiously as possible.
Accordingly, CRM (M) 235 of 2026 stands rejected. (Kausik Chanda, J.)
