A copy of such affidavit has been supplied to the learned advocate for the petitioner and the State. Mr. Banerjee learned advocate appears for the State and seeks time to take instruction as to when the retiral benefits shall be released in favour of the petitioner. The learned advocate appearing for the respondent No.9 submits that the 9th respondent is ready and willing to liquidate the outstanding loan amount and the same may be deducted from his retiral benefits. He submits that the State respondent be directed to deduct the outstanding loan amount including interest which is due from the

respondent No.9 to the petitioner society from the retiral benefits and thereafter release the balance amount on account of retiral benefits to the 9th respondent. He submits that the retiral benefits are yet to be released in favour of the 9th respondent.

The learned advocate appearing for the petitioner submits that a sum of Rs.1908557/- was lying due and outstanding as on January 6, 2026 from the respondent No.9 to the petitioner/co-operative credit society. He however, submits that out of the said mount a sum of Rs.122000/- has already been paid by the respondent No.9 to the petitioner/society.

The co-operative society shall intimate the District Inspector of Schools (Secondary Education), being the respondent no. 6 the amount which is due to the petitioner society from the 9th respondent within a week from receipt of a server copy of this order.

Upon receipt of such intimation the respondent No.6 shall deduct the said amount from the retiring gratuity and pay the amount to petitioner/society in satisfaction of any debt or demand of the society against the 9th respondent and the balance amount, if any, be paid to the respondent No.9 in accordance with law as expeditiously as possible but positively on or before the end of the month of May, 2026.

The school authorities are also directed to co-operate in this regard with the State, the petitioner and the respondent No.9.

With the above observations and directions WPA 1211 of 2026 stands disposed of.

There will be no order as to costs.
