Affidavit of service filed on behalf of the petitioners is taken on record.
Learned counsel appearing on behalf of the petitioners submits as follows. The private respondents had come up with an illegal construction on government land near the petitioner's property. This is blocking the ingress and egress to the petitioner's property. Accordingly, on 29.01.2024 the petitioners made a representation before the respondent authorities including the Sub-Divisional Officer, Haldia for taking action in terms of the provisions of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962. However, the representation has not been responded to as yet. Learned counsel appearing on behalf of the State submits that in the event, the representation is pending consideration, the same shall be considered in accordance with law.
Despite service, no one appears on behalf of the private respondents.
It appears that the petitioners' representation dated 29.11.2024 is pending consideration before the concerned authorities.
In view of the above, let the Sub-Divisional Officer, Haldia consider the petitioners' representation dated 29.11.2024 in accordance with law and upon hearing the petitioner and other interested parties as expeditiously as possible, preferably within a period of eight weeks from the date of communication of this order.
It is made clear that the merits of the case have not been gone into.
With these observations, the writ petition is disposed of. As affidavits were not called for, allegations contained in the writ petition are deemed not to have been admitted. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
