The petitioner is a confirmed Assistant Teacher at Motilal Primary School, a school under Kariali Circle of Malda District Primary School Council.

The petitioner is praying transfer to another school under a different circle of the said Council on the ground that he is a surplus teacher of his present school.

The representation of the petitioner dated December 16, 2024 to the said effect is the pending consideration before the Chairman of the Council, the respondent no. 3 herein.

The said respondent is directed to consider the said representation of the petitioner only on the ground that the petitioner is a surplus teacher of his present school and shall dispose of the same in accordance with law.

W.P.A. 1049 of 2025 is disposed of with the above terms without any order as to costs.
