The State of West Bengal and others (Through Video Conference) Mr. Ratan Das, Advocate ... for the petitioner Mr. Jahar Lal De, Mr. Supratim Dhar, Advocates ... for the State In this petition an allegation has been made that some anti-social elements are digging Government vested land as well as wet land and shifting and selling out soil from Harapur, Goalpota, Belekhali, Kheyadaha and from other places also. Along with the petition, a mass representation before the local respondents filed on 24.12.2021 has been annexed.

Learned counsel for the State has produced documents showing that on the complaint of the petitioner, Block Land Reforms Officer accompanied with the police personnel had conducted an enquiry on 20.01.2022 and had found that there was clear sign of extraction of earth and a JCB was found but was not in use which was seized. It has also been noted that extraction of earth at the spot caused damage to the surrounding area of the extraction of spot.

Hence, we are of the opinion that on the petitioner's complaint, appropriate action has already been taken. If in future the petitioner notices any illegal digging of the

WPA (P) 19 of 2022 earth then they will be at liberty to file the complaint to the competent authority who will take immediate action on the said complaint.

With the aforesaid observations, the present petition is disposed of.
