Learned advocate appearing for the petitioner submits that the petitioner is in custody for alleged recovery of 25 bottles of phensedyl from his possession. It has been further contended that the petitioner is in custody for about six months and charges have been framed against him.

Learned advocate for the State opposes the prayer for bail and submits that witness action is about to commence in the month of February, 2026.

I have taken into account the quantum of seizure and the period of detention. Having regard to the same, I am of the view that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Tapan Roy shall be released on bail

upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District and Sessions Judge, 6th Court, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of North 24 Parganas without the prior permission of the learned special court. Accordingly, CRM (NDPS) 117 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
