AD 18 February 18, 2026 Ct. 28 SG CRM(A) 212 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Samsherganj P.S. Case No.1010 of 2025 dated 26.10.2025 under Sections 115(2)/117(2)/118(2)/126(2)/ 109(1)/3(5) of the BNS.

Sharma ... for the petitioners Mr. Anupam Dasadhikari Mr. Mainak Gupta ... for the State Learned counsel for the petitioners submits that the petitioners are not the principal accused in this case. The two accused, who are specifically named by the victim in his statement, were granted bail after a few days of custody. Learned counsel for the State strongly opposes the prayer for anticipatory bail, refers to the injury report and the NCCT of face.
The NCCT of face reveals fracture with associated changes as described in the report. While a victim specifically stated about two particular blows given by the other co-accused, it is also his case that all the accused had surrendered him and attacked him with weapons. There was also an assault on the lower part of the body, though no
particular name was mentioned in this regard. On the other hand, as per the statement of the eyewitness, all the accused had actively participated in the assault on the victim. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Presence of the investigating officer is noted and is dispensed with.
