Mr Sandipan Dey .... for the petitioner Mr. Bhaskar Prasad Vaisya Mr. Joydip Banerjee ..... for the State Mr. Nilotpal chatterjee Mr. Satyaki Banerjee ..... for the Calcutta University A letter from the College to the Controller of Examinations of the University dated 6th September, 2021 would show that the petitioner failed in the Nuclear Physics Paper in the B.Sc. Semester-VI(General) Examination(Under CBCS), 2021 due to the mistake of the College. By the said letter, the College hence requested the University to correct the petitioner's marks before publication of the result.

Learned counsel appearing for the University, submits that the Controller of Examination may be directed to correct the petitioner's marks, so the petitioner can pass in that particular paper.

After hearing learned counsel, since this is the stand taken by the University, the respondent No. 5 being the Controller of Examination,

University of Calcutta is directed to make the necessary correction in the petitioner's marks in the concerned paper before publication of result. Since the University has not taken any steps after September, 2021, the Controller of Examination is directed to take necessary steps within two weeks from date. There shall be no further delay on behalf of the University.

WPA 856 of 2022 is disposed of accordingly.

The petitioner shall have the liberty of mentioning this matter if there is any delay. Since the result of the petitioner has already been declared, the University is directed to publish the petitioner's result afresh after making the necessary corrections.
