Case No.446 of 2025 dated 15.05.2025 under Sections 329(3)/351(2)/62/64 of the BNS, 2023. And In the matter of: Palash Sk @ Amik Sekh ... petitioner Mr. Arnab Chatterjee Mr. Avik Ghosh Ms. Ankusha Ghoh ... for the petitioner Mr. Partha Pratim Das Mr. Rahul Ganguly ... for the State Learned counsel for the petitioner submits that on 11.05.2025 the petitioner tried to violate the alleged victim and on 14.05.2025 he threatened the victim and her husband. An FIR was lodged on 15.05.2025. The petitioner has been falsely implicated in this case. Charge-sheet has been submitted.

Learned counsel for the State strongly opposes the prayer for anticipatory bail, relies on the statements of the victim and the post-occurrence witnesses and submits that the post-occurrence witnesses stated that after hearing the hue and cry they came there and saw the petitioner was dragging the victim for committing rape. When the others came, he fled away from there. It appears that if the neighbours had not come there hearing hue and cry, the victim would have been assaulted.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
