The present appeal has been preferred against an ad interim refusal of injunction.

Learned counsel for the appellant submits that the appeal has been rendered infructuous in view of the temporary injunction application itself, in connection with which initially ad interim injunction was refused, has since been disposed of by granting temporary injunction in favour of the plaintiff/appellant.

Affidavit-of-service filed in court today be kept on record.

In view of the above submissions, FMA 1392 of 2018 along with CAN 1 of 2017 (Old No: CAN 9047 of 2017) are dismissed as infructuous without any order as to costs.

Needless to say, we have not entered into the merits of the matter and it will be open to the parties to urge all points at the trial of the suit.
