The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.
The plaintiff in a suit for eviction of licensee is the petitioner of the instant application under Article 227 of the Constitution of India.
The plaintiff is complaining inordinate delay in disposal of the said suit.
It appears from the record that the suit had once reached the stage of peremptory hearing, but it was taken off the peremptory hearing Board as the defendant had filed an application for amendment of the written statement. The said application is still pending.
The petitioner is praying a direction upon the learned Court below for expeditious disposal of the said application. In view of the nature of the suit, the application for amendment needs to be disposed of expeditiously, therefore the learned Trial Judge is requested to dispose of the said application as expeditiously as possible in accordance with law, preferably within a period of two weeks from the date already fixed for hearing of the said application.
The learned Trial Judge is further requested to expedite the disposal of the suit and to adhere to the aforesaid direction, the learned Trial Judge shall not entertain prayer of the parties for any unnecessary adjournment.
C.O. 143 of 2025 is disposed of with the above terms without any order as to costs.
