Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of co-accused and no tangible evidence is available so far as the present petitioner is concerned.

Learned advocate for the State opposes the prayer for bail and submits that 502 grams of brown sugar were recovered from a co-accused and from his statement the petitioner was implicated in connection with the instant case. However, learned advocate for the State is unable to dislodge the issue that except statement of the coaccused there are no other materials. It has been submitted that the petitioner has antecedent of three other cases two of which

relate to NDPS Act and another under Section 103 of BNS. Having considered in this case that the petitioner has been implicated on the basis of the statement of the co-accused and there has been no recovery from him or other attending circumstances are available, I am of the view that further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Alam Sk shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District and Sessions Judge, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Malda without the prior permission of the learned special court.

Accordingly, CRM (NDPS) 119 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
