1. Matter is heard in presence of the learned advocates representing the parties.

2. Learned advocate representing the petitioner has filed supplementary affidavit affirmed on 9th June, 2025 and same is taken on record.

3. It is submitted on behalf of the petitioner that in the writ petition petitioner claimed certain benefits including transport allowance at the higher rate in view of the fact that petitioner was declared orthopedically disabled vide certificate dated 7th December, 1992 as the petitioner suffered bullet and sprinter injury while posted in Kashmir.

It is further submitted that petitioner is going to retire with effect from 1st December, 2025.

4. However, drawing attention of this Court to an order dated 22nd May, 2025 issued by the Assistant commandant (Min)/AO FTR HQ BSF

SB it is apprised to this Court on behalf of the petitioner that towards transport allowance at higher rate which petitioner is entitled to payment has been made but petitioner questions quantification of payment made in his favour. It is submitted that petitioner is entitled to receive additional benefits beyond the payment which has already been made.

5. Union of India is represented by learned advocate who has prayed for accommodation to obtain instruction.

6. It appears that writ petition was filed on 14th January, 2025 and no purpose would be subserved in keeping this writ petition pending taking note of the fact that payment towards enhanced transport allowance has already been made to the petitioner.

7. Keeping in view of the fact that petitioner questions quantification of the amount payable to the petitioner, leave is granted to him to make a representation demonstrating his entitlement to receive further amount by fortnight from date to the Special Director General (EC) Border Security Force, South Bengal, Kolkata being respondent no. 3. On receipt of such representation respondent no. 3 shall decide the same in accordance with

law by 4 (four) weeks thereafter and a reasoned order shall be passed which shall be communicated to the petitioner by 10 days thereafter.

8. Writ petition stands disposed of.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
