The petitioner claims to be the leader of the opposition in the Chawki Mirdapur gram panchayat. Several allegations have been levelled with regard to the conduct of the Pradhan in matters of inviting e-tenders. The allegations of mal practice, favouritism, suppression of materials facts, etc., have been made.

The District Magistrate, Malda shall treat the writ petition as a representation and dispose of the same in accordance with law, upon granting an opportunity of being heard to the petitioner as also the respondent no.5. A reasoned order shall be passed and communicated to all concerned.

Needless to mention, if the authority comes to a conclusion that the allegations of the petitioner are correct or partially correct, remedial measures shall be taken in accordance with law so that such incidents are not repeated in future.

The petitioner is directed to serve a copy of the writ petition along with a server copy of this order upon the District Magistrate, Malda.

The entire exercise shall be completed within a period of eight weeks from date of receipt of the copy of the writ petition along with a server copy of this order. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
