Matter is heard in presence of the learned advocates representing the petitioner and the State respondents.

Learned advocate representing the State respondents has filed a written instruction along with supporting documents and same are taken on record.

Grievance of the petitioner is in spite of the orders passed by the West Bengal Administrative Tribunal on 10th August, 2009 and 6th February, 2023, steps have not been taken by the concerned respondent authorities to update her service book as the petitioner is working as Supervisor in Chapra ICDS Project, Nadia.

It is also submitted by the learned advocate representing the petitioner that on updating service book of the petitioner certain service benefits which require to be extended in her favour have not been granted.

Learned advocate representing the State respondents relies upon memo dated 3rd October, 2024 of the Director of ICDS, West Bengal addressed to the Child Development Project Officer, Chapra ICDS Project, Nadia and another memo dated 21st November, 2024 of Child Development Project Officer, Chapra ICDS Project, Nadia addressed to the Director of ICDS, West Bengal.

Both the aforesaid memoranda dated 3rd October, 2024 and 21st November, 2024 are annexed to the written instructions filed today on behalf of the State respondents.

On perusal of those two memoranda, it appears that as per direction of the West Bengal Administrative Tribunal as contained in the order dated 6th February, 2023, Director of ICDS, West Bengal requested the concerned Child Development Project Officer to update the service book of the petitioner vide memo dated 3rd October, 2024 and in pursuance thereof it was intimated by the concerned Child Development Project officer vide memo dated 21st November, 2024 that service book of the petitioner was updated.

However, it is disclosed in the memo dated 21st November, 2024 by the Child Development Project Officer, Chapra ICDS Project, Nadia that benefits
under career advancement scheme could not be started in favour of the petitioner since Open Performance Report (OPR) was not submitted by the petitioner.

Learned advocate representing the petitioner has disputed the aforesaid contention and has submitted that petitioner is entitled to the benefits under career advancement scheme.

As it appears from aforesaid two memoranda dated 3rd October, 2024 and 21st November, 2024 that service book of the petitioner was updated in terms of the order of the West Bengal Administrative Tribunal dated 6th February, 2023, writ petition stands disposed of.

However, leave is granted to the petitioner to make a representation claiming service benefits including benefits under career advancement scheme to the Director of ICDS, West Bengal being respondent no.2 by fortnight from date.

If said representation is made within the aforesaid time, respondent no.2 is directed to decide the same after granting opportunity of hearing to the petitioner or her representative by eight (8) weeks thereafter and the decision of the respondent no.2 shall be communicated to the petitioner by fortnight
thereafter. Respondent no.2 shall pass a reasoned order based on representation, if made by the petitioner.

Child Development Project Officer, Chapra ICDS Project, Nadia being respondent no.7 is directed to supply copy of the updated service book to the petitioner by seven (7) days from the date of communication of the order.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
