Petitioner is aggrieved by the act and action of the Officer-in-Charge, Nalhati Police Station. To that effect, petitioner has expressed his grievance before the learned Executive Magistrate. But, I do not find that any communication made to the superior officer of police.

Learned advocate for the private respondents disputes the nature of accusation so far as the right relating to the property is concerned as has been stated in the writ petition.

Learned advocate for the State has submitted a report. The information furnished is against the public servant in the year 2023.

Having considered that more than 1/1⁄2 years have passed, the same public servant in all probability is not discharging the duty in the same police Station.

Having regard to the changed circumstances, I direct that in case the petitioner has further grievance, he would approach the superior authority. The superior authority would dispose of the representation of the petitioner in accordance with law.

With the aforesaid observations, WPA 925 of 2024 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
