This is an application for unconditional withdrawal of the appeal being FA 29 of 2012.

The letter of instruction from the appellants to the learned Advocate for the appellants in this regard is annexed to this application.

CAN 2 of 2025 is, thus, allowed.

In view thereof, the appeal stands dismissed as withdrawn.

In Re: CAN 3 of 2025 5.

The learned Counsel for the plaintiff/decree holder has filed this application for leave to withdraw the amount of Rs.4,00,000/- with accrued interest deposited at the time of admission of the appeal on 17th May, 2012.

In view of the fact that the appeal has been withdrawn, we permit the application for withdrawal of a sum of Rs.4,00,000/- with accrued interest deposited by the appellants in terms of the order dated 17th My, 2012. 7.

The learned Registrar General is directed to encash the fixed deposit and remit proceeds thereof to the plaintiff/decree-holder on proper identification within a period of a fortnight from the date of communication of this order.

CAN 3 of 2025 is, thus, allowed.
