The instant appeal is preferred at the behest of the appellant/claimant challenging the impugned judgement and award dated 7.8.2008 passed by the learned Motor Accident Claim Tribunal Judge, Fast Track Court-1, 24-parganas, South, Alipore.

There is no representation on behalf of the respondents.

It appears that this case is pending since for a considerable period of time. It is submitted by the learned Counsel on behalf of the appellant that presently she has no contact with the appellant. I find appellant/claimant has lost interest to proceed further with the present case. So, there is no justification to keep this case alive in the list. Accordingly, the FMA being 395 of 2009 is hereby dismissed for default.

Interim order, if any stands vacated.

There will be no order as to costs.
