It is undisputed before this Court that respondent no. 6 was granted the electricity connection for running the submersible pump pursuant to an order dated November 5, 2024, passed in WPA 17595 of 2024 (Arsad Ali vs. State) by a Coordinate Bench of this Court.

Learned counsel for the petitioner, however, submits that the petitioner had made a representation before the Regional Grievance Redressal Officer, Purba Burdwan, regarding the electricity connection provided to respondent no. 6. The petitioner prays for the consideration of this representation.

Learned counsel for respondent no. 6, on the other hand, submits that since the petitioner's representation has not yet been considered by the Regional Grievance Redressal Officer, Purba Burdwan, the petitioner may prefer an appeal before the Ombudsman in accordance with the West Bengal Regulatory Commission Rules, 2006.

However, I am not inclined to accept this submission. It appears that the representation was made on November 30, 2024, and the present writ petition was filed on January 9, 2025. It is possible that, due to the pendency of the writ petition, the Regional Grievance Redressal Officer, Purba Burdwan, has not yet decided the representation on its merits.

In view of the above, I dispose of this writ petition with a direction to the Regional Grievance Redressal Officer, Purba Burdwan, to consider the petitioner's representation, as indicated on page 24 of the writ petition, in accordance with law. The Officer shall consider the matter within a period of two months from the date of this order, after providing an opportunity for hearing to both the petitioner and respondent no. 6. A reasoned order shall be passed and communicated to the parties immediately thereafter.

With the above observations and directions, WPA 1092 of 2025 is disposed of.

There shall be no order as to costs.
