Learned advocate appearing for the petitioner submits that petitioner and his parents are similarly situated so far as the accusations are concerned. The parents have been granted bail but the petitioner presently has not been granted bail and is in custody for one year ten months. It has been submitted that out of 13 witnesses cited by the prosecution only one witness till date has been examined.

Learned advocate for the State draws the attention of the Court to the statement of the wife of the deceased which has been recorded by the learned Judicial Magistrate.

I have taken into account the same and I am of the view that at this stage it would not be fit and proper to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (M) 193 of 2026 is rejected at this stage.

The prosecution would complete at least five more witnesses in the next three months.

Petitioner would renew his prayer for bail after the said period is over.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
