The petitioner's grievance is that their application for sanction of a building plan in respect of 32/2(Plot No. 95, Sahapur Colony(W), Ward No. 81, K.M.C. Kolkata700053 has not been considered by the respondent authority till date.
The petitioners rely upon a communication dated October 16, made to the Executive Engineer(Building) Department, the Kolkata Municipal Corporation, Borough-10 forwarding certain documents which included the Title Deed, Site Plan, Proposed Plan for Sanction, CESC bill, Adhar Card, Voter's I.D.Card and Death Certificate of their father.
The learned advocate appearing on behalf of the Kolkata Municipal Corporation submits that the necessary document required for sanction of the building plan has not been forwarded by the petitioners. In view of the submissions made by the parties the instant writ petition is disposed of by directing the respondent no. 4 being the Executive Engineer (Building) Department, the Kolkata Municipal Corporation, Borough-10 to take a decision with regard to the application for sanction of building plan filed by the petitioners, strictly in accordance with law, at the earliest, but positively within a period of four months from the date of communication of a copy of this order. The said authority shall intimate the petitioners the documents to be filed and the formalities required to be complied with for the purpose of approval of the building sanction plan.
WPA 1173 of 2021 stands disposed of.
Affidavit-of-service filed in Court is taken on record.
Urgent photostat certified copy of this order, if applied for be given to the parties after completion of all legal formalities.
