On May 8, 2023, the matter was adjourned on the prayer of learned counsel for the petitioner.

It is seen that vide order dated May 1, 2023, it was observed, inter alia, that prima facie the court did not find any proof that the petitioner is in settled occupation of the property concerned. Upon such observation being made, learned counsel for the petitioner had sought liberty to file a supplementary affidavit annexing further documents to indicate prima facie that the petitioner is in occupation of the property-inquestion.

Even from the previous records, it is seen that the petitioner has consistently been absent when the matter was call on for hearing.

In view of such repeated defaults on the part of the petitioner, WPA No. 973 of 2023 is dismissed for default.

Interim order, if any, stands vacated.

There will be no order as to costs.
