Ms. Paramita Mitra ... for the Petitioner(s) Ms. Sonali Das Mr. Dipankar Paramanick ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for three years and seven months and it has been informed that charge has only been framed on 17th January, 2026. Learned advocate also submits that the prosecution intends to rely upon nine witnesses in order to prove its case, as such, on any stringent conditions, the petitioner may be released on bail.
Learned advocate for the State, on the other hand, opposes the prayer for bail in view of the 3.2 kg of codeine mixture having been seized.
I have taken into account the period of detention of the present petitioner and I am of the view that further detention of the present petitioner is unwarranted.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Md. Faisal @ Kaish shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, Barrackpore. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of North 24 Parganas without prior intimation to the learned trial court. Accordingly, CRM(NDPS) 124 of 2026 is allowed. Pending application(s), if any, is also disposed of. CD be returned to the learned advocate for the State.
