The petitioner was an Headmaster of Panchsowa Rabindra Vidyapith (H.S), Bolpur Shantiniketan, District- Birbhum, on attaining the age of superannuation he has retired from his said service on October 31, 2023.

The petitioner is complaining delay in disbursement of his retiral benefits.

Admittedly, a criminal case is pending against the petitioner, disentitling him to get the full pension but he is entitled to provisional pension. The District Inspector of Schools (S.E.), Birbhum, the respondent no. 3 herein, is, therefore, take necessary steps for release of such provisional pension and the school authority is directed to take steps to release the provident fund amount of the petitioner.

The respondent no.3 and the school authority shall complete their respective drills within a period of eight weeks from the date of communication of this order.

Since no affidavit has been invited, the allegations made in the writ petition are deemed not to have been admitted by the respondents. W.P.A. 942 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
