It is submitted on behalf of the petitioner no narcotics was recovered from his possession. He was available for investigation but not arrested. Investigation is complete. Petitioner has been falsely implicated. Accordingly, he prays for anticipatory bail. 2.

Learned Advocate for the NCB submits report enclosing the petition of complaint.

Materials placed before us show 21 kgs. of Ganja was recovered from one Bhim Biswas. Call Detail Records (CDRs.) collected during investigation show petitioner had repeated telephonic conversations between the said accused and others who are implicated in the case. Inspite of notice under Section 67 of the NDPS Act, petitioner did not cooperate with investigation. Warrant of arrest has been issued. 4.

Under such circumstances and as quantity of narcotics seized is above commercial quantity attracting restrictions under Section 37 of the NDPS Act, we are not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
