By the present writ petition, the petitioner seeks for direction upon the respondent authorities to give actual basic pay to the petitioner and also to give normal increment of the year 2022.

The petitioner contends that she was appointed as an Assistant Teacher in Palasia Primary School under Jhakra Circle, District Paschim Medinipur on 14th May, 2004. The petitioner has been confirmed in the service with effect from 19th October, 2006.

Subsequent thereto, on 8th July, 2010, the petitioner was transferred to Kuthikonarpur, Ghatal West Circle. The petitioner on discharge of her continuous duties received the benefit of 10 years on 14th May, 2014 alongwith normal increment on 1st July, 2014. On 12th May, 2022, the petitioner applied for 18 years benefit of her service which was also duly granted. However, the normal increment of the year 2022 was

refused as the benefit of 10 years was given to the petitioner prior to 30 days of it being falling due. The petitioner is willing to repay the said extra amount of one month to the concerned authority. On 20th September, 2023, the petitioner made representation for redressal of her grievance, however, the same is still pending consideration. Hence this writ petition. 3.

Mr. Sayan Banerjee, learned advocate appearing for the petitioner submits that the matter be relegated to the appropriate authority for due consideration of the representation of the petitioner in accordance with law.

Mr. Arjun Roy Mukherjee, learned advocate appearing for the State concedes to such submission.

In view of the submissions advanced by the respective parties, respondent no. 3, the Chairman, District Primary School Council, Paschim Medinipur is directed to consider the representation of the petitioner dated 20th September, 2023 and dispose of the same by passing a reasoned order in accordance with law, upon notice to the petitioner, within a period of twelve weeks from the date of communication of this order.

The reasoned order shall be communicated to the petitioner within a week from the date of passing of such order.

The petitioner is directed to communicate this order to respondent no. 3, the Chairman, District Primary

School Council, Paschim Medinipur for necessary compliance.

With the above directions, the writ petition being no. WPA 957 of 2024 stands disposed of.

Since no affidavits have been called for, the allegations made in the writ petition are deemed to be not admitted.

10. Consequently, connected applications, if any, also stand disposed of.

11. Interim orders, if any, stand vacated.

12. There will be no order as to costs.

13. Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Bivas Pattanayak, J.)
