Report filed by the learned counsel appearing on behalf of the State-respondents be taken on record. The petitioners submit that the plot of land owned by them was acquired in LA Case No. 4/6 of 2012-13 for the purpose of reconstruction of Aila affected Sundarban embankment and possession of the land was taken on July 12, 2012. The petitioners learnt that the award with regard to the said land was declared on December 12, 2013 but unfortunately despite several communications made by the petitioners with the authorities, the compensation has not been paid to them till date. Relying upon the report submitted by the Special Land Acquisition Officer, South 24-Parganas, learned counsel appearing on behalf of the State submits that the award was declared on July 02, 2013 and the cheques were made ready on December 24, 2013 for disbursement. He candidly submits that the authority shall hand over
the cheques to the petitioners within a period of fortnight from date.
In view of the above, the writ petition is disposed of with liberty to the petitioners to approach the 3rd respondent for disbursement of the chques issued in their favour. The 3rd respondent shall disburse such cheques within a period of fortnight thereafter.
The petitioners shall receive the cheques without prejudice to their rights and contentions.
With the above observations and directions this writ petition being WPA No. 903 of 2022 is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
