CAN 2 of 2021 has been filed seeking condonation of delay in filing the appeal.

Having regard to the pleadings made in the instant application explaining such delay, this Court is inclined to condone the delay.

Accordingly, CAN 2 of 2021 is allowed.

Re.: MAT 34 of 2021 With CAN 1 of 2021 4.

The appeal is directed against an order dated 14th September, 2020 passed by a Single Bench of this Court. By the said order the Single Bench has upheld the order dated 28th July, 2020 which cancelled the tender process where the appellant/writ petitioner participated.

The Single Bench found that the reason for cancelling the tender process was sound and sufficient. 6.

With the passage of five years after the tendering process, fresh tender may also has been issued and work may be completed by this time.

In view of the above, nothing further remains to be adjudicated in the instant appeal.

This Court cannot even otherwise find fault with the impugned order. The appeal may have already become infructuous.

In view of the above, MAT 34 of 2021 is disposed of without any order.

10. Consequently, connected pending application being CAN 1 of 2021 is also disposed of.

11. There shall be no order as to costs.
