The petitioner claims that he is entitled to a moratorium and other benefits in accordance with the Reserve Bank of India's Circular dated April 17, and other circulars and guidelines.

The Bank is represented.

Learned advocate appearing for the Bank submits that the petitioner is a defaulter and the account of the petitioner became a nonperforming asset.

It appears that the Reserve Bank of India from time to time issued various circulars and guidelines with regard to the moratorium and other benefits, one of them being April 17, 2020. There is a circular subsequent thereto also.

In such circumstances, the Bank will consider the writ petition as a representation of the petitioner.

The Bank will consider whether the petitioner is entitled to moratorium and other benefits in accordance with the subsisting guidelines and circulars of the Reserve Bank of India or not. In the event, the petitioner is found to entitle, such moratorium and other benefits, the Bank will provide such facility to the petitioner and will re-work the account of the petitioner, if necessary. The Bank will intimate the result of consideration of the application for moratorium and other benefits made by the petitioner, in accordance with the law, to the petitioner within a period of four weeks from date.
