Ms. Santi Das (Bhowmick), learned Advocate appearing for the appellant submits, on instruction received from her client, that her client is not interested in pursuing the instant appeal and prays for dismissal thereof.

In view of the above, the instant appeal is dismissed as not pressed. Consequently the connected applications are also dismissed. All the interim orders, if there be any, stand vacated.

Our attention is drawn to the order dated 23rd April, 2008 passed by the Division Bench imposing condition of depositing a sum of Rs.10,000/- with the Registrar General of this Court as a condition precedent for grant of injunction against the respondent. Since the appeal is dismissed for nonprosecution, the appellant is permitted to take back the said amount. In the event such prayer is made before the Registrar General, the Registrar General shall ensure that the said amount is paid subject to her satisfaction over the identity of the appellant.
