Learned senior advocate appearing for the petitioner submits that, the petitioner is sought to be proceeded against on the basis of a confessional statement made by the petitioner and that only a part of the so-called murder weapon was recovered from the petitioner. There is no eye witness of the incident.

Learned Additional Public Prosecutor draws the attention of the Court to the seizure list. He submits that, murder weapons were recovered on the basis of the leading statement made by the petitioner.

Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the

case diary and considering the fact that the murder weapon was recovered on the leading statement made by the petitioner and considering the fact that there is hardly any material change in circumstances subsequent to the earlier order of rejection, we are unable to grant bail to the petitioner.

In such circumstances, prayer for bail of the petitioner is rejected and the application being CRM (DB) 158 of 2022 is dismissed.
