Ghosh ...for the State Let the report filed by the State be taken on record. 23-02-2026 AKG Ct. 15 The petitioner contends that respondent no. 7 obtained a sanctioned building plan in respect of plot nos. 2321 and 2322 from the Bharatpur Gram Panchayat by suppressing material facts. It is alleged that a partition suit between the parties is presently pending, in which an injunction order is in force restraining the parties from altering the nature and character of the suit property.

The petitioner submits that, while applying to the Prodhan of the Bharatpur Gram Panchayat for sanction of the building plan, respondent no. 7 failed to disclose the existence of the said suit and the subsisting injunction order, and thereby obtained approval of the plan. Learned counsel appearing on behalf of the petitioner further submits that the petitioner submitted a representation dated October 8, 2025, before the Prodhan of the Bharatpur Gram Panchayat; however, no steps have been taken by the Panchayat pursuant thereto. In view of the foregoing, the writ petition is disposed of

with a direction upon the Prodhan of the Bharatpur Gram Panchayat, respondent no. 5 herein, to consider and dispose of the representation dated October 8, 2025, within a period of one month from the date of communication of this order.

The Prodhan shall afford an opportunity of hearing to the petitioner as well as respondent no. 7 before passing a reasoned order in accordance with law.

Accordingly, WPA 1218 of 2026 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
