None appears on behalf of the Block Land & Land Reforms Officer.

Learned advocate representing the contemnor submits that the unauthorised construction could not be identified.

It appears from records that the Board of Administrators of the Bansberia Municipality had issued notice to one Dhanonjoy Chatterjee requiring him to stop construction as the same commenced without sanction of the building plan and in breach of the provisions of the Municipal Act.

The present submission of the contemnor that the unauthorised construction cannot be identified appears to be made out of desperation. Had the construction not been identified, then the stop work notice could not have been issued. It is only after the unauthorised construction was noticed that direction was passed upon the person raising such unauthorised construction to forthwith discontinue the same.

The Municipality is directed to take immediate steps to comply with the direction passed by the Court and file affidavit of compliance on the adjourned date. 6.

Re-list the matter on 17th April, 2025.
