The applicants have prayed for recalling of the order dated 13th January, 2021 in MAT 26 of 2021 with CAN 01 of 2021 on the ground that this matter was supposed to appear after 18th January, 2021 but it appears from record that this matter was disposed of on 13th January, 2021. It is stated in Paragraph 2 of the said application that although the matter was appearing on 13th January, 2021 but the matter was ultimately adjourned till 18th January, 2021. Similar matters challenging judgment and order of the learned Single Judge in relation to 12th RLST (AT), 2011 was disposed of on 13th January, 2021. This appeal also involves same and similar questions of law and, accordingly, this appeal also shall stand dismissed in terms of our order dated 13th January, 2021.
We do not have any definite recollection as to whether this matter was adjourned till 18th January, 2021. However, this issue has now become academic and inconsequential in view of our order dated 13th January, 2021 disposing of similar matters by affirming the order passed by the learned Single judge.
The recalling application being CAN 2 of 2021 stands disposed of.
