Kausik (Rejected) CRM (NDPS) 127 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1754/2025 dated 11.10.2025 under Section 21(C)/27A/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that petitioner has been arrested on the basis of statement of co-accused and there was no recovery from the possession of the present petitioner.
Learned advocate for the State, on the other hand, submits that investigation of the case is continuing and prima facie it reflects that a racket is operating wherein the petitioner happens to be one of the participants, as after the initial seizure apart from the petitioner other accused was arrested and on the basis of leading statement of such accused. further recovery has been made.
Having considered that the investigation of the case is still in progress, I am of the view at this stage it would not be fit and proper to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.
Thus, CRM (NDPS) 127 of 2026 is dismissed.
Leave is granted to the petitioner to correct the cause title.
Department is directed to incorporate necessary corrections.
