The present revisional application was preferred challenging the order dated 21.11.2022 passed by learned Chief Judicial Magistrate, Chanchal, Malda in Case No. 79M/21 under Section 125 of the Code of Criminal Procedure. By the said order, a quantum of interim maintenance of Rs.5000/- per month was awarded by the learned Additional Chief Judicial Magistrate, Malda. The husband/petitioner at this stage intends to canvass his points at the stage of trial by adducing appropriate evidence. Accordingly, the learned Magistrate would allow the parties to adduce their evidence and take the case to its logical conclusion within a reasonable period of time.

Having considered that the case was initiated in the year 2021, the learned Magistrate would fix at least one date in every 60 days so that trial of the case can be concluded within a reasonable period of time.

With the aforesaid observations, the revisional application being CRR 144 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
