An affidavit of compliance has been filed by the Pradhan, Jenkapur Gram Panchayat wherefrom it appears that the Panchayat detected unauthorized construction and forwarded all papers relating to such construction to the SubDivisional Officer, Kharagpur vide communicating memo dated 2nd April, 2025.

Learned advocate representing the petitioner submits that despite detection of unauthorized construction, the Sub-Divisional Officer has not taken any steps in the matter and the person responsible for making unauthorized constriction is merrily continuing with further unauthorized construction.

On perusal of the affidavit of compliance, it appears that the Pradhan has already forwarded the observation that the construction complained of was made without any sanction plan.

Accordingly, the Sub-Divisional Officer, Kharagpur ought to take necessary steps in the matter in accordance with law.

It will be open for the petitioner to follow up the matter with the Sub-Divisional Officer for further relief.

The contempt application stands disposed of.

In view of the disposal of the contempt application, the connected application, being CAN 1 of 2025, also stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
