Mr. Sandip Chakraborty .....For the State Petitioner is directed to hand over a copy of the revisional application upon Mr. Sandip Chakraborty, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned authorities and is directed to represent the case for the State.

Learned advocate appearing for the petitioner draws the attention of this Court to the order dated 14.07.2022 passed in CRR 30 of 2020. Learned advocate submits that the said revisional application was allowed, however, the warrant of arrest which was earlier pending is creating an apprehension that in case he appears before the learned Special Court he may be taken into custody in spite of the earlier revisional application being allowed.

Petitioner is directed to appear before the learned Special Court on or before 28th February, 2023. Learned Trial Court would take into

account the judgment and order passed in CRR 30 of 2020 by a Coordinate Bench on 14.07.2022. Records reflect that the petitioner was on bail, but subsequently, warrant of arrest has been issued. In view of the set of circumstances which have been brought to the notice of this Court, I direct that in case the petitioner appears before the learned Special Court within 28th February, 2023, he may be allowed to continue on the same bail and bond and the learned Trial Court would be at liberty to impose such conditions as it deems fit and proper. The execution of warrant of arrest so issued be stayed till 1st March, 2023. The petitioner shall once in a week attend Chakulia Police Station till he appears before the learned Trial Court within the scheduled date so fixed. Once the petitioner appears such conditions would be deemed to be waived.

With the aforesaid conditions, C.R.R. 145 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
