No 29 KAUSHIK (REJECTED) C.R.M (A) 277 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Ranaghat Police Station Case No. 126 of 2021 dated 23.05.2021 under Sections 448/325/376/511/379/506/34 of the Indian Penal Code, 1860.

And In Re : Sanjay Adhikari ..... petitioner Ms. Sananda Bhattacharya .... for the petitioner Mr. S.S. Imam Mr. A. Manna ... for the State Petitioner seeks anticipatory bail.

Learned advocate appearing for the petitioner submits that, the petitioner was falsely implicated. The wife of the defacto complainant obtained loan from the petitioner. Learned advocate appearing for the State submits that, the petitioner is the principal person involved in the incident. Other co-persons surrendered and obtained bail from the Jurisdictional Court. The Investigating Officer is yet to come across any loan transaction.

There is nothing on record to suggest that there was a loan transaction. Considering the gravity of the offence and considering the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 277 of 2022 is dismissed.
