The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such service of notice of this application upon the said opposite parties is dispensed with.

The petitioner is the plaintiff of the Ejectment Suit being Title Suit No. 41 of 2014, pending before the learned Civil Judge (Senior Division) at Purba Dardhaman.

The petitioner complains that the suit although has been posted for peremptory hearing, but disposal of the same is being deferred due to the dilatory tactics adopted by the defendants/opposite parties.

The petitioner, therefore, prays for a direction upon the learned Trial Judge for disposal of the said suit within a specific time.

The Courts, during this Covid-19 pandemic period are slowly resuming normal

functioning, at this stage direction for disposal of any lis within a specific period is not warranted. However, considering the nature of the suit and the stage to which the connected suit has reached, this Court expresses its desire that the learned Trial Judge shall make all endeavour to dispose of the said suit expeditiously and in doing so shall not grant any unnecessary adjournment to either of the parties.

C.O. 66 of 2021 is disposed of with the above terms.

There shall be no order for costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
