AND In the matter of:- Nikhil Chandra Das ... petitioner The present revisional application has been preferred against the judgement and order dated 02.07.2010, passed by the learned Chief Judicial Magistrate, Jalpaiguri, in Misc. Case No.83 of 2006 under Section 125 of the Code of Criminal Procedure. The order reflects that by the said order the learned Magistrate was pleased to allow the application under Section 125 of the Code of Criminal Procedure and directed for maintenance of Rs.7000/- towards one child and Rs.3,000/- towards another child. By the said order, the learned court was pleased to direct that such order would be effected from the month of July, 2010. Having regard to the passage of time which has passed in the meantime and the leave which was sought, for preferring an application for condonation of delay on 28.06.2011 when the revisional application appeared before a coordinate Bench of this Court, I am of the view that at this belated stage no interference is called for in respect of the impugned order.

Accordingly, C.R.R.1 of 2011 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act in terms of copy of this order downloaded from the official website of this Court.
