Mr. Sambuddha Dutta ... for the State - Respondent(s) Mr. Partha Chakraborty ... for the respondent nos.5&6 The petitioner claims that he was coerced by the respondent no.5/his son to sign on a gift deed. The respondent no.5, thereafter, sold out the property to the respondent nos. 6 and 7.

It has also been alleged that the petitioner was assaulted. Presently, the petitioner is staying at a different location, where even, the respondent no.5 threatened him.

Learned advocate for the respondent nos. 5 and 6 is present and disputes the accusations made by the

petitioner in the writ petition.

Learned advocate for the State has submitted a report, which reflects that the police authorities have already drawn up a proceeding under Section 126 of the BNSS pursuant to the information so received.

Having considered the nature of the problem which has cropped up inter se the family members, I direct that, in case, the petitioner informs the police authorities, the police authorities, within a fortnight, would ensure that no torture is inflicted upon the petitioner at the behest of the respondent no.5.

In the meantime, it is directed that the petitioner should approach the appropriate authorities under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. If any direction is passed by the said authority, the local police station and/or the concerned police

authorities would obey, respect and implement such order/direction.

With the aforesaid observations, WPA 1227 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. Copies of the report be handed over to both the parties.
