Petitioner has challenged the continuance of Kharagpur Town Police Station Case No.273 of 2023 wherein on conclusion of investigation, charge-sheet was submitted under Sections 341, 323, 354B and 506 of the Indian Penal Code.

Learned advocate appearing for the petitioner submits that the petitioner has been implicated falsely in connection with the instant case along with the other cases at the instance of the de facto complainant. To that effect, attention of the Court was drawn to the date and time of the incident of this case as also the other cases which have been initiated at the instance of the sister of the de facto complainant.

I find from the charge-sheet that certain references to injuries have been complained of and to that effect, a doctor has been cited as witness. Having considered the same, I am of the view that, at this stage, this Court will not interfere when date has been fixed by the learned trial court for consideration of charges. The petitioner would be at liberty to canvass all the issues in the present

revisional application before the learned trial court at the stage of consideration of charges. The learned trial court will dispose of the application, if any, filed by the petitioner independently without being influenced by any observations made by this Court. With the aforesaid observations, CRR 186 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
