For the State The records of the revisional application reflects that after 14th January, 2021 none appeared on 3rd February, 2021 and 4th February, 2021 when the matter appeared before the Co-ordinate Bench. Today also when the matter has been taken up, none appeared on behalf of the petitioner.

As none appeared on behalf of the State Mr. Abhra Mukherjee, learned advocate who ordinarily appears on behalf of the State is directed to represent on behalf of the State. His appearance may be regularized by the concerned authorities. The subject-matter of the case relates to Muchipara Police Station Case No.17 dated 26.01.2019. The revisional application was filed with documents which are private and personal in nature and are not sufficient enough to be considered for interfering with the process of investigation which commenced. Further, there was no interim order stalling the investigation of the case which was registered in January, 2019. More than three and half years have passed and the investigation would either be at the advanced stage or charge-sheet has already been filed before the Jurisdictional Court. There is presumably a change of circumstances with the passage of time.

Having regard to the same, I am of the opinion that no interference is called for in the present revisional application.

Accordingly, C.R.R. 101 of 2021 is dismissed. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
